Statutory Contract Terms NBC 2016 Part 4 Standards Engineering Service Agreements

Terms & Conditions

These contractual terms govern the engineering design, turnkey installation, fire extinguisher supply/refilling, annual maintenance contracts (AMC), and government Fire NOC consultancy services executed by HFC India Pvt. Ltd.

Last Updated : October 2026

01 Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (whether individually or representing a commercial, industrial, or institutional facility) and HFC India Pvt. Ltd. ("Company", "We", "Us", or "Our"), concerning your access to hfcfire.com and the engagement of our fire engineering services.

By accessing our website, requesting on-site surveys, approving quotations/BOQs, or signing work orders, you acknowledge that you have read, understood, and agreed to be bound by these Terms and statutory Indian safety provisions.

02 Technical Site Surveys & BOQ Estimations

Calculations provided via our online Cost Estimator widget are ballpark technical approximations based on standardized industry metrics. Formal execution relies on physical site inspections:

  • On-Site Measurement Audit: Final BOQs (Bill of Quantities) are determined strictly after physical surveys of plot elevations, structural pipe routing, static water head availability, and building occupancy hazard categorizations.
  • Validity of Quotations: Engineering estimates and commercial proposals issued by HFC India remain valid for thirty (30) calendar days from the date of issuance, subject to steel (MS pipe) and brass market price fluctuations.
  • Revisions: Any subsequent architectural alterations, plant expansions, or structural reconfigurations made by the client will necessitate a revised BOQ submission.

03 Installation, Testing & BIS Standards

All fire safety execution works undertaken by HFC India comply with national code mandates:

  • Hydrant Pipeline Testing: Heavy-gauge MS Class-C pipelines undergo mandatory hydrostatic pressure testing at a minimum of 10.5 kg/cm² for 24 continuous hours as mandated under IS 13039 and IS 1239.
  • Automatic Sprinkler Systems: Installation complies with IS 15105 and NFPA standards, utilizing calibrated K-factor brass sprinklers and UL/FM compliant glass bulb triggers.
  • Fire Alarm & Detection (FAPS/FDSS): Addressable systems, optical detectors, and clean agent flooding skids are commissioned under IS 2189 and NFPA 72/2001 protocols.
Testing Sign-Off: The client’s authorized engineer must sign the physical pressure testing and flow calibration log sheets upon completion of commissioning drills.

04 Fire NOC & Statutory Liaison Terms

In our capacity as Fire Safety Consultants and Liaisoning agents:

  • HFC India prepares accurate architectural fire drawings, hydraulic calculation notes, and statutory compliance files for submission to the Haryana Fire Services Department, Municipal Corporations, or Urban Local Bodies (ULB).
  • Government Discretion: While HFC India guarantees 100% technical compliance with NBC Part 4 norms, the formal issuance of the Fire NOC / Renewal Certificate remains the sovereign prerogative of government fire department authorities.
  • Statutory Delays: HFC India shall not be held liable for administrative delays caused by government server downtimes, policy revisions, or departmental inspection scheduling backlogs.

05 Fire Extinguishers & Refilling Warranty

Terms governing fire extinguisher procurement, hydraulic testing, and gas/powder refilling:

  • Refilling Standards: Extinguishers are refilled strictly with BIS-certified ABC MAP 50/90 powder, CO2 gas, or mechanical foam in accordance with IS 2190.
  • Warranty Period: Refilled cylinders carry a 1-year leakage and pressure gauge warranty, provided the tamper seal and safety pin remain intact.
  • Rejection on Safety Grounds: If a client's old cylinder fails hydrostatic pressure testing or shows severe structural corrosion, HFC India reserves the right to condemn the unit in compliance with gas cylinder safety regulations.
Important Safety Notice: Discharging cylinders during non-emergency situations or improper handling voids all refilling warranties.

06 Annual Maintenance Contract (AMC) & Service SLAs

Under HFC India comprehensive or non-comprehensive AMC agreements:

  • Scheduled Audits: Our certified engineering technicians conduct quarterly preventive visits covering pump room pressure testing, diesel engine battery health checks, jockey pump automation, and riser landing valve greasing.
  • Emergency Response SLA: For critical pump room breakdowns, emergency technician dispatch is initiated within 24 hours across Palwal, Faridabad, Sikri, and NCR industrial clusters.
  • Spare Replacements: In non-comprehensive AMCs, replacement components (e.g., pressure switches, butterfly valves, panel relays, diesel engine starter motors) are billed separately based on pre-approved rates.

07 Client Site Readiness & Cooperation

For seamless turnkey project execution, the client agrees to provide:

  • Safe and unhindered access to the installation area, static underground/overhead water tanks, and electrical control rooms.
  • Reliable 3-phase electrical power and sufficient raw water supply required for on-site hydrostatic pipeline pressure testing and flow tests.
  • Secure storage space for heavy MS pipes, valves, cable drums, and delicate addressable fire panel equipment during the installation tenure.

08 Invoicing, Milestone Payments & Taxes

Commercial transactions are structured around standard engineering milestones:

  • Turnkey Projects: Staged billing typically comprises: (1) Advance with work order for raw material mobilization, (2) Milestone payment on delivery of MS pipes and pump sets, and (3) Final payment upon commissioning and pressure test handover.
  • Goods and Services Tax (GST): Applicable GST (18%) is levied on all equipment supplies, refilling services, and engineering consultations as per Indian tax laws.
  • Interest on Overdue Bills: Invoices unsettled beyond thirty (30) days from the due date are subject to an interest charge of 18% per annum until settlement.

09 Limitation of Liability & Force Majeure

Fire systems are engineering mitigation measures designed to control hazards. Liability boundaries are defined as follows:

  • HFC India shall not be held liable for system operational failure if the client fails to maintain minimum water tank levels, disconnects power to fire pumps, bypasses alarm panel circuits, or ignores mandatory AMC servicing.
  • Force Majeure: Neither party shall be held responsible for project delays caused by acts of God, severe floods, civil strikes, state-wide lockouts, or unforeseen supply chain disruptions beyond reasonable engineering control.

10 Governing Law & Judicial Jurisdiction

These terms, service agreements, and work orders are governed by and construed in accordance with the laws of the Republic of India.

Any legal dispute, arbitration proceedings, or claim arising out of turnkey installations, AMC contracts, or services rendered by HFC India Pvt. Ltd. shall be subject to the exclusive jurisdiction of the competent courts located in Palwal / Faridabad, Haryana, India.
